Terms and Conditions

These Terms and Conditions shall apply to the services

provided to the client (‘Client’) by The Mind Pilot (‘TMP’). 

Acceptance 

Instructions to proceed with 'the project', whether received verbally or in writing shall be deemed to be full and complete acceptance of these terms and conditions. 

Payment Terms 

TMP will issue to the Client an invoice for the full project upon Acceptance.  Client shall pay each invoice within 10 days. 

The invoice shall be deemed paid once TMP receives such payment as cleared funds in its nominated bank account. 

Failure to make payment by the times specified shall entitle TMP to treat such failure as cancellation by Client and charges shall be payable as specified below. 

Changes and Cancellation 

In the event of total or partial cancellation by Client, cancellation charges shall be payable by Client upon notification by Client of such cancellation as follows: 

  1. All costs incurred or committed to by TMP with respect to the project 

  2. A proportion of TMP’s fees as follows:  

From acceptance of programme and/or auxiliary services 50% of fees 

Between 90 and 30 days prior to programme and/or auxiliary service commencement 75% of fees 

Within 30 days prior of programme and/or auxiliary services commencement 100% of fees 

Liability 

  1. Mentoring takes the form of a confidential conversation between the TMP and Client. When a Client is under the age of 18 (a minor), a parent’s written authorisation will be sought prior to the initial Mentoring and Coaching session. 

  2. Mentoring and Coaching are not a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical condition. 

  3. Information shared by the Client will be treated as confidential unless otherwise agreed with the Client, as required by law or as set out below. 

  4. If the Client is a minor and reports abuse, neglect or threatens harm to themselves or someone else, necessary action will be taken including disclosure of confidential information to the law, parent/guardian or third party. 

  5. TMP will advise a parent or relevant third party if the Mentor believes the Client is at any risk, or if the Mentor has any material concerns. 

  6. TMP will inform the Client of safeguarding guidelines and policies. 

  7. TMP and/or the Mentor are not and will not be liable or responsible for any actions or inaction, or for the direct or indirect result of any services provided by the Mentor. TMP makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the Mentoring services. TMP will not have any liability for any indirect, consequential or special damages. 

  8. TMP shall not be liable for any loss or additional expenses caused to Client by delay or interruption to travel services and cancellation in the event of war, or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disasters, fire, technical problems to transport, closure or congestion of airports or ports, cancellations or changes of schedules by scheduled airlines and similar events beyond our control.  Such losses or additional expenses shall be the responsibility of Client. 

  9. The Mentor’s entire liability under this Agreement and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Mentor under this Agreement for all Mentoring and Coaching services rendered through and including the termination date. 

  10. TMP shall not be liable for any loss, damage or injury-sustained or additional expense incurred by Client as a result of Client's negligence or that of a person/s outside TMP’s sphere of responsibility. 

  11. TMP retains all intellectual property rights, whether owned or licensed, in any documents, copy, data, text, trademarks, brands, logos, information, specifications, drawings and material provided by TMP or the Mentor from time to time.
